Hi All,

I just tried to extend my warranty for a few more years, but a problem seems to have come up. The insurance guy told me my car was listed as USED so he couldn't give me the warranty.

I got it with 72mi on the odo. The insurance guy tells me occasionally they put new cars down as sold to fudge numbers at the end of the month/year.

Anyone know what I can do about this? Kinda aggrevated at the moment and I don't even know who I should be mad at...:soap:

Oh well, any help would be appreciated.

Hmmm - can't remember, but doesn't your title list the car as a new sale or used? I seem to remember seeing that on mine, but I may be mistaken..

I'd also be on the phone to the dealer I picked it up from ASAP and see what their story is - always possible it's just a screwup on the paperwork..

Ahhhhh okay...

So I finally had time to go to the dealer today and this is what they told said in a nutshell. That for some reason in Feb of 08 they made it look like the car was sold to get their dealer incentives from MB. They then in Dec of 08 sold me the car as new (and no one told me about this finagling of numbers).

NOW... they say that I only have two options. One, to get "black market" warranty with them, which means that I can only take it to that dealership to get it serviced. Don't worry, this isn't even an option to me. And second, have the warranty expire and then they would do something where they would cpo the car and get an extra year for used car warranty. AND the kicker is... they started warranty on the car in Feb of 08 since that's when it ceased being "new".

So I'm loosing 10 months of warranty off the top, and can't get it the regular way now. They tell me I'm out the 10 months from the beginning no matter which way I go. They also try to placate me by telling me the dealer incentives they got went into making the price of the car lower. This was NEVER mentioned, as I'm sure I would've turned down "B" stock.

So please please, can someone suggest what I should do next? It seems wrong that I should get sKr*Wd for essentially them committing numbers fraud. I really don't want to make a federal case outta this, I just want to extend my dern warranty!!

p.s. Dan or anybody know if this is a common practice amongst dealers? They made it seem like it was for them, at any rate.

Our VW Sharan only had 26 miles on the clock when we bought it in Jan 2005, but it was first registered in Oct 2004 and that's when the OEM warranty started. I did however know that when I bought the car and I did get it for a stellar price (about 30% discounted from a new one!!).

If they didn't tell you, then they are in my view guilty of mis-selling. Good luck, I hope you get a result... :)

:confused:Sorry to hear the details of your situation. Losing ten months of the factory warranty is the worse part. I've never worked in the car industry and I'm sure things like this go on all the time. We have two SLKs that were purchased used. I purchased MB extended warranties on each PRIOR to the expiration of the factory warranty. Sounds like your dealer makes their own rules. Check with another dealer on the extended warranty.

I did get a good deal on the car, but not THAT good a deal to where I'd be suspicious. Never knew I had to make sure my new car was a new car, especially from the dealer.

I'm TRYing to get the warranty extended before the factory warranty runs out, AND I started this whole thing trying to get an extended warranty from a different dealer. They tell me as long as it says used, they can't do anything.


So thus far there doesn't seem to be any sort of recourse I can take with this. Would MB even care? The guy I talked to seemed to imply that they do this so much that they themselves don't even know which cars have been shuffled from column 'a' to column 'b'.

Please, any more suggestions? My righteous indignation might be fired up atm, but I still think this is wrong, and there must be some way to correct it.

It does happen sometimes, personally i don't permit it and we tend to operate on a custom-order basis as do most dealers here in the UK but I'm gonna go out on a limb and say that in the US where dealers tend to order a number of best sellers in a common spec it happens considerably more often.

If you order a load of car's and have them sitting around gathering dust then MB wants to know what the hell is going on so by registering the car it looks like it has been sold, the downside being the factory benefits start at that point, hence your 'new' warranty is now about to expire.

All that being said it should not cause the extended warranty issue your having, so what if the car is listed as used, MB sell an extended warranty that you can have on ANY car provided it is taken out before the factory warranty expires or if it has already expired that you pay a fee (about the same as a small service) to have the car inspected, at least that is how it works in the UK.

I would be on the phone to MB saying why can't i have a warranty on a used car, if they supply you with one then i would get the dealer to pay the cost for a year to replace your factory warranty, whatever you do don't let the dealer buy it back and resell it to you because then its third-hand.

I'd definitely get in touch with MBUSA on your lost warranty. On the extended warranty, IMO the best extended warranty you can get is to put the money in the bank for when/if you need repairs. I have never bought one and never had a car where I ever needed one. It's just an insurance policy and in the long run, the insurance companies always win.

Thanks Len,

I normally woudn't get an extended warranty either, but I figure on these cars, any little fix would be in the thousands; so the $3500 they quoted me doesn't seem very extravagant. The cost of a few minor repairs or a moderate to severe one the way I figure it.

Horse sh1t - if they don't know what cars have been moved from "a" to "b", how can they have "discounted" the car since it's in the "b" column??!

In Louisiana, it's illegal to sell a car as "new" if it's not "new". I'd find it hard to believe it's not the same pretty much everywhere in the states?

Even if you got a stellar deal on the car, I'd :

1] Get the situation in writing for the dealer who sold you the car.
2] If you financed, did you finance as "new" or "used" car?
3] Write a letter to the General Manager of the dealership, cc'd to MBUSA outlining the situation and your dissatisfaction at what you feel to be a "shady" deal at best.
4] I'm hoping MBUSA (who got screwed by the dealer, from the sound of it) will be willing to push things in the right direction..
5] Find a local lawyer - sounds like something they'd take on contingency.

1. Will work on that. They actually showed me a print out of how they played with the numbers; hopefully they'll give me a copy.

2. Paid cash, no financing. But the title states that it's a new car right on top.

3. Already sent a letter to MBUSA. Will work on a slightly less courteous letter to the owner of Walter's MB.

Thanks for the advice, but I'd ideally like to avoid bringing litigation into this. I've read numerous posts from this site stating the futility of such action. It might come down to that, but I'm delaying this as long as possible.

Gah. I'd be polite, and explain that this is an issue of a dealer misrepresenting the product sold, and asking for clarification that MBUSA is not in a position to take a stand on the issue.

Is there anything in your original purchase paperwork explaining that you would not be getting full warranty coverage?! Look for anything that mentions the "In Service" date of the car.

I still don't understand how it's legal for a car to be sold as "New" on the title, without it actually being "New" - also surprised that the dealer's not willing to do the right thing - extend the warranty at no cost to you - to keep your business.

Given that you live in Kali, I'd actually think that you have some legal remedy, regardless of your desire to exercise it. Might be worth asking around, but again - don't see how you can purchase "new" and get less than "new" coverage.

Best of luck in your search for satisfaction - hope it works out. Dealers like this *really* piss me off.

Thanks for the sympathy John, it's really appreciated. Will check the title and all the initial paperwork tonight after I get home to see if they slipped anything into them.

This is just getting to be a giant PitA, I'm sure a simple elegant solution could be found, but it doesn't seem like my dealer or MB is interested in finding one. Well, live and learn I guess...will keep you guys posted.

If you are a member of MBCA, they have an ombudsman contact person at MBUSA to help resolve problems such as this.
